Therese Kuester focuses her practice on matters involving the Foreign Corrupt Practices Act (FCPA), including conducting pre- and post- acquisition due diligence, internal and government investigations, and compliance program enhancements. She also engages in designing and implementing risk assessment strategies to help clients mitigate corruption effectively. 

Ms. Kuester earned her J.D. with honors from the George Washington University Law School, where she was an associate of The George Washington Law Review and a Writing Fellow. During law school she was a judicial intern to the Honorable Timothy J. Kelly at the U.S. District Court for the District of Columbia and an extern in the Office of Foreign Litigation and Office of International Judicial Assistance at the U.S. Department of Justice (DOJ). Prior to law school, Ms. Kuester worked as an analyst at an international law firm, supporting international judgment enforcement and cross border dispute matters. 

Representative Engagements
  • Served as a member of the monitorship team under a multi-national company's FCPA resolutions with the DOJ and SEC. The resolutions required an external monitor for a term of two years followed by a year of self-reporting by the company. 
  • Assisted with pre-acquisition due-diligence for FCPA and human rights issues as a member of the legal defense team for a global chemical and mining company's global investigations counsel.
  • Served as a member of Miller & Chevalier's team representing a large multinational company in an investigation by the SEC related to allegations of corrupt conduct in two countries in the Middle East. The investigation spans both internal controls and anti-bribery allegations.
  • In a Latin American country, conducted a risk assessment for a multinational company on modifying its compliance program there to meet local anti-corruption compliance expectations.
