Miller & Chevalier Files Amicus Brief Addressing Attorney-Client Privilege and Work-Product Protections Under the Contractor "Mandatory Disclosure Rule"

Washington, DC, December 4, 2019 – Miller & Chevalier Chartered recently filed an amicus brief addressing an issue of critical importance to federal government contractors on behalf of the Chamber of Commerce of the United States of America and The Coalition for Government Procurement. The brief urged the U.S. District Court for the Eastern District of Virginia to reconsider an earlier ruling in which the court found that a federal contractor waived the protections of the attorney-client privilege and work-product doctrine via a disclosure under the so-called "Mandatory Disclosure Rule." As explained in the filing, which is available here, contractors have been making robust disclosures to the government for more than a decade with the settled understanding and expectation that it does not result in a broad subject matter waiver of privilege or work-product protections.

The case is Anderson v. Fluor Intercontinental, Inc., Civ. No. 19-CV-00289 (E.D.V.A.). The amicus brief was authored by the cross-disciplinary litigation team of Alejandro (Alex) Sarria, Katherine Pappas, Jason Workmaster, and Timothy O'Toole.
