Therese Kuester focuses her practice on internal and government investigations and the design, implementation, and assessment of corporate compliance programs. She primarily advises clients on matters involving corruption, fraud, money laundering, business and human rights, workplace conduct, and other areas of corporate compliance. Her work spans a variety of industries, including health care, telecommunications, finance, and extractives. 

Ms. Kuester earned her J.D. with honors from the George Washington University Law School, where she was an associate of The George Washington Law Review and a Writing Fellow. During law school she was a judicial intern to the Honorable Timothy J. Kelly at the U.S. District Court for the District of Columbia and an extern in the Office of Foreign Litigation and Office of International Judicial Assistance at the U.S. Department of Justice (DOJ). Prior to law school, Ms. Kuester worked as an analyst at an international law firm, supporting international judgment enforcement and cross border dispute matters. 

 

Representative Engagements
  • Served as a member of the monitorship team under a multi-national company's FCPA resolutions with the DOJ and SEC. The resolutions required an external monitor for a term of two years followed by a year of self-reporting by the company. 
  • Assisted with pre-acquisition due-diligence for FCPA and human rights issues as a member of the legal defense team for a global chemical and mining company's global investigations counsel.
  • Served as a member of Miller & Chevalier's team representing a large multinational company in an investigation by the SEC related to allegations of corrupt conduct in two countries in the Middle East. The investigation spanned both internal controls and anti-bribery allegations.
  • In a Latin American country, conducted a risk assessment for a multinational company on modifying its compliance program there to meet local anti-corruption compliance expectations.
  • Assisted with a post-acquisition due diligence assessment of a company in the extractives industry with a focus on FCPA, workplace culture and conduct, and human rights risk. 
  • Served as a member of a team that conducted an independent investigation on behalf of a large state university on governance, workplace conduct, retaliation, and culture issues affecting the highest level of the institution.
  • Served as a member of a team that was engaged by a professional organization to investigate certain allegations raised by stakeholders. 
  • In a Latin America country, investigated allegations of corruption in the tendering of government contracts.
