Miller & Chevalier FCPA Teleconference
As reflected in our FCPA Summer and Autumn Reviews, significant enforcement and legislative developments relating to the FCPA and global anti-corruption laws occurred in the second and third quarters of 2010. The Miller & Chevalier FCPA and International Anti-Corruption Practice Group held an invitation-only teleconference discussing these events and their consequences for anti-corruption compliance. The one-hour session included a discussion of the following 2010 developments:
- Recent corporate enforcement actions, including ABB, Eni, and Technip;
- The focus of the DOJ and SEC on prosecution of individuals and the likely byproducts of this strategy;
- Increase in civil litigation, including shareholder actions, based on FCPA activity;
- DOJ Guidance from recent Opinion Procedure Releases;
- U.K. Ministry of Justice's issuance of draft guidance regarding the recently passed (but not yet implemented) U.K. Bribery Act; and
- Whistleblower provisions and extractive industry reporting requirements in the Financial Reform legislation.
