What the DOJ's New FCPA Guidelines Mean for Latin American Business

Ellis suggested that scrutiny in the region is likely to intensify, particularly in cases involving cartels, national security, and foreign companies that disadvantage U.S. competitors. "Latin America has been perhaps the most important region for FCPA cases," Ellis wrote, citing that about 40 percent of corporate enforcement actions between 2018 and early 2025 involved misconduct in the region. "The new FCPA Guidelines suggest that Latin America will remain center stage."
