In this Law360 article, Tim O'Toole commented on the U.S. Department of Justice's (DOJ) inadvertent publishing of unredacted testimony regarding technical data subject to the International Traffic in Arms Regulations (ITAR) in connection with a case accusing a magnet manufacturer of unlawfully sharing sensitive military data with China. "I certainly think the government agencies would read this to mean that the inadvertent release without government approval, or even intentional release without government approval, does not make something public and take it out of the realm of the ITAR," O'Toole said.
