Joanne Roskey Quoted on Mental Health Parity Enforcement Pause in Law360

Subtitle
"Takeaways for Benefits Attys after Parity Enforcement Freeze"

Law360

Joanne Roskey, former Deputy Associate Solicitor at the U.S. Department of Labor (DOL) and former Chief of the Division of Health Investigations in DOL's Employee Benefits Security Administration (EBSA), commented on the recent freeze on enforcement of the Biden-era mental health parity regulations, acknowledging the complexity of the regulations and welcomed the pause as "at least temporary relief" from an "opaque" system. She noted that while the DOL must still request 20 comparative analyses annually under existing law, the rule's enforcement pause won't likely lead to a broad withdrawal of mental health coverage by employers. Roskey added she'll be closely watching how federal agencies carry out their promised reevaluation of the enforcement and regulatory landscape, calling it "a pretty comprehensive undertaking."
