Anthony F. Shelley was quoted following a presentation given to the National Association of Insurance Commissioners. Shelley said that while challenges to the ACA are often dismissed, the Texas v. United States case should not be. "This is not a frivolous lawsuit," he said. If the case "is not thrown out on procedural grounds," and if the plaintiff states win on the merits in lower courts, "it will inevitably land at the Supreme Court, and Chief Justice Roberts will once again be the key vote."
