Miller & Chevalier's representation of Blue Cross & Blue Shield Association (BCBSA) in Helfrich v. Blue Cross & Blue Shield Ass'n, an appeal related to preemption of state law by the Federal Employees Health Benefits Act (FEHBA), was covered in BNA Pension & Benefits Daily. The Tenth Circuit upheld the lower court's ruling in favor of BCBSA, confirming that FEHBA preempts state laws limiting subrogation and reimbursement of benefits when there is a third-party recovery. Firm Members Anthony F. Shelley and Adam P. Feinberg represented BCBSA in the appeal.
