Health Plan Fiduciaries - Ways to Avoid Litigation Based on High Fees

Joanne Roskey will speak at "ERISA: Beyond the Basics," a CLE program co-sponsored by the American Bar Association (ABA) Joint Committee on Employee Benefits (JCEB) and the American College of Employee Benefits Counsel. Roskey will participate in the panel presentation, "Health Plan Fiduciaries - Ways to Avoid Litigation Based on High Fees" on May 7, 2024. The panel will discuss Consolidated Appropriations Act, 2021 (CAA) requirements for transparency on pricing and fees charged to health plans and the need for fiduciaries to understand what to do with this information and how to use it to negotiate lower fees. The panel will highlight CAA provisions that can assist fiduciaries in obtaining information to determine if health plans are being overcharged for services and address potential litigation risks facing fiduciaries responsible for monitoring fees changed to health plans.
