Marc Gerson, George Hani, and Robert Kovacev will speak at the 58th Annual Southern Federal Tax Institute on October 30 and November 1, 2023, in Atlanta.

On October 30, Gerson will present, as part of a panel, "Tax Legislative Outlook." Speakers will provide their perspectives on the current tax policy landscape, review recently enacted legislation and Treasury-promulgated guidance, and address what additional legislation has the potential for enactment given the current political environment.

On November 1, Kovacev will present, "Where's My Refund? IRS Scrutiny of R&D, ERC and Other Tax Credit Refund Claims." Hani will serve as moderator. The IRS has aggressively examined research tax credit claims with this enforcement strategy taking a new turn when the IRS imposed new requirements for research credit refund claims starting in 2022. Additionally, the IRS is prioritizing enforcement against taxpayers claiming the Employee Retention Credit. Kovacev will discuss why taxpayers planning to claim either credit should anticipate an unprecedented level of scrutiny and be prepared to overcome new hurdles in order to defend their claims.

Hani will also moderate the following panels on November 1:

"The Latest and Greatest on the BBA," a presentation providing practical overview of the BBA process and discuss solutions to these important questions.
    
"Tax Implications of Conservation Easement Donations: Recent Developments," a panel providing an overview of ongoing developments and litigation in the area of conservation easement donations, including syndicated conservation easements.

"Fixing Federal Tax Mistakes," a discussion providing a range of potential options to fix tax mistakes that will also highlight ethical obligations that arise when considering how to best address prior mistakes.
