Timothy O'Toole was quoted in an article in which USA Today presented copies of internal Justice Department rules about sharing evidence with criminal defense lawyers. O'Toole, who is one of the Chairman of a National Association of Criminal Defense Lawyers (NACDL) panel that has been pushing Congress to enact similar measures, said, "I think these policies are actually the right policies. The biggest problem is that nobody outside the prosecutor's office actually knows what those policies are." USA Today obtained these documents through a Freedom of Information Act (FOIA) request. The NACDL has sued to obtain a copy of a more detailed guide for prosecutors, known as the Blue Book, that the Justice Department did not release in this request.
