Rocco Femia is quoted on the OECD’s discussion draft regarding transfer pricing and intangibles, as well as the possibility of a U.S. legislative action in the area. Regarding current international tax reform discussions, Femia said that "there is a view in Washington that to the extent there are changes in this area, there will be a legislative change to address base erosion because it's such a prevalent issue," adding, "there's a lack of confidence by policymakers in either the arm's-length standard conceptually or the ability of Internal Revenue Service to administer or enforce the arm's-length standard."
