Rocco Femia notes that the CIP and the proposed cost-sharing rules on which it is based allow for more reasonable treatment under contingent payment arrangements going forward. Femia adds, however, for a five-year-old cost-sharing arrangement, "is it fair to impose in an audit context a method that is not specified and that requires work to have been done then that can't be done now?"
