"FCPA Outlook for Brazil and Mexico"

Matteson Ellis discussed his view on the Foreign Corrupt Practices Act (FCPA) outlook for Brazil and Mexico. "Brazil-related FCPA cases will likely continue to drop from their Lava Jato-era height, but they will still be significant… There is simply no way around the fact that the Brazilian economy is massive and, no matter the administration in power there, it will continue to attract outside investment." Many industries in Brazil face significant government touchpoints, he said, and corruption continues to be a core threat to doing business.

"Corruption scandals in Mexico continue to surface on what seems to be a weekly rate," Ellis said. President Andrew Manuel Lopez Obrador's (AMLO's) son was provided housing by a Pemex contractor, a scandal that has put the administration on the defensive. Because AMLO has been hostile towards outsiders, many international companies have been shying away from investment in the country. "Nonetheless, the presence of multinational corporations in the country is well established, and they will continue to face corruption risk, endemic in the country," Ellis noted.
