Lauren Briggerman discussed the launch of the Department of Health and Human Services (HHS) and the Department of Justice (DOJ) False Claims Act (FCA) Working Group as a pivotal moment for Medicare Advantage (MA) scrutiny. She called it "a new chapter of more aggressive scrutiny" and emphasized that the program has become a prime target because "Medicare Advantage is where the biggest federal dollars are." As the FCA task force begins deploying advanced data analytics to detect fraud, Briggerman said risk adjustment practices – particularly chart reviews – will face increased investigation. She pointed to recent cases involving inflated patient risk scores and flagged potential vulnerabilities in payer procedures. Her advice to MA providers is to ensure their compliance programs are robust and proactive: "MA payers should effectively monitor their chart review procedures and conduct regular audits of their billing records." Briggerman also urged renewed vigilance over third-party relationships, adding, "To the extent they use outside vendors, they should also renew their due diligence of these vendors to reduce any risk of improper score inflation."
