In this podcast, Lauren Briggerman discusses the latest edition of Miller & Chevalier's newsletter, Executives at Risk: Navigating Individual Exposure in Government Investigations-Spring 2017, which covers recent developments in significant government investigations. She discussed aggressive the tactics prosecutors have taken in these investigations, including raids in Germany of an outside law firm retained in the Volkswagen emissions investigation, multi-agency raids by U.S. agents of Caterpillar Inc.'s offices in a ballooning tax investigation, and the Department of Justice (DOJ) Antitrust Division's raid of a trade association meeting of the world's largest shipping container companies. The Volkswagen raid on an outside law firm is "highly usual" and "very concerning to the defense bar and to corporate executives" because privileged documents are at stake, Briggerman said. With respect to the shipping container industry raid, "the FBI caught this rare window where a lot of these foreign executives were coming in from abroad for this international meeting, so they were able to essentially ensnare these corporate executives while they were on U.S. soil to serve the subpoenas," Briggerman said. "We'll see if this leads to something big."
