Joanne Roskey, former Deputy Associate Solicitor at the U.S. Department of Labor (DOL) and former Chief of the Division of Health Investigations in DOL's Employee Benefits Security Administration (EBSA), commented on a series of DOL policy reversals following President Trump's return to office. Among them, the DOL – alongside the Departments of Health and Human Services (HHS) and the Treasury – announced a freeze on enforcement of mental health parity rule requirements introduced last September. The pause stems from a legal challenge brought by the ERISA Industry Committee (ERIC) and delays implementation of heightened comparative analysis regulatory mandates under the 2020 Consolidated Appropriations Act. "It did relieve plans and plan service providers from a lot of work that was going on to try to fully implement those provisions," Roskey said. "It's a welcome reprieve from those obligations, for sure." She emphasized that while the enhanced requirements are paused during litigation, plans are still required to conduct comparative analyses under the statute's original mandate.
