Joanne Roskey, former Deputy Associate Solicitor at the U.S. Department of Labor (DOL), Plan Benefits Security Division (PBSD), commented on the Department's amicus brief supporting plan sponsors in litigation over the use of forfeited 401(k) assets. The amicus brief is likely to have an impact both within and outside the 9th Circuit, Roskey said, "Because courts generally give DOL's view on ERISA due regard and in part because this is the first case of its type in which DOL has weighed in on the plausibility of the claims asserted."
