Expect U.S. Enforcers' Cartel Crackdown to Continue

Law360

In this article, Matteson Ellis, Maria Elena Lapetina, and Alexandra Beaulieu examine the Trump administration's continued focus on cartel enforcement following the designation of drug cartels as Foreign Terrorist Organizations (FTOs). They explain that such designations "gave the U.S. government certain authorities under the Anti-Terrorism Act and otherwise to prosecute entities and individuals who provide material support to the designated parties," and warn that "corporate actors can be both criminally and civilly liable for providing support to FTOs." The authors further note that "companies can easily find themselves in the enforcement crosshairs," particularly as the U.S. Department of Justice, the Office of Foreign Assets Control and the Financial Crimes Enforcement Network, among other U.S. regulators, continue to pursue various "coordinated and extraordinary steps to target cartel-related activity throughout Latin America."
