"Miller & Chevalier's Bradley Markano on Trade Fraud False Claims Act Cases"

Corporate Crime Reporter

In an interview with Corporate Crime Reporter, Bradley Markano discussed the Department of Justice's (DOJ) newly launched cross-agency Trade Fraud Task Force, announced in August 2025. The Task Force will pursue enforcement actions under the Tariff Act of 1930, the False Claims Act (FCA), and federal criminal statutes, targeting tariff violations, customs fraud, and supply chain misrepresentations. Markano noted that "ignorance of links in the supply chain can have significant consequences," and emphasized that companies should "redouble their supply chain due diligence" as scrutiny intensifies. He also highlighted the administration's intent to use the FCA to enforce policy priorities in trade, customs, and beyond.
