In this article, Alex Sarria commented on the U.S. Supreme Court's decision to reinstate state tort claims against defense contractor Fluor Corporation, noting that the ruling could have significant consequences for government contractors operating in active military environments. Sarria said the Court adopted a "surprisingly narrow view" of the combatant activities exception, "limiting it to scenarios where a contractor's challenged conduct can fairly be treated as the military's own conduct or decision." That standard, he warned, is "unworkable in modern military deployments," where contractors are asked to support "virtually every facet of the military mission, but not always told how."
