Washington DC, November 10, 2010 – In a long-pending case brought under the False Claims Act, the United States District Court for the District of Columbia on November 4, 2010 granted in its entirety the motion to dismiss filed by Miller & Chevalier on behalf of its client, PAE Government Services, Inc.

The False Claims Act permits private citizens, known as qui tam relators, to file suit on behalf of the government against contractors when the plaintiff has evidence that the contractor is perpetrating a fraud on the government. The plaintiff alleged that PAE and two contractors engaged in a systemic scheme to defraud the United States Department of Agriculture. Lawyers for Miller & Chevalier successfully argued to Judge Gladys Kessler that the plaintiff's allegations as to PAE were insufficiently specific, and that a plaintiff could not properly base his claim against one defendant on allegations aimed at entirely separate defendants.

Miller & Chevalier's latest victory marks the second time in the same year that Judge Kessler granted a motion to dismiss filed by Miller & Chevalier on behalf of PAE. After the first dismissal, the plaintiff was allowed to amend his complaint. The judge's latest order, however, dismisses the case with prejudice.
