"Lawyers Call for Greater Pushback Against SEC's Use of FCPA Accounting Provisions"

Global Investigations Review

Mark Rochon was quoted regarding the Securities and Exchange Commission's (SEC's) expansive and unsupported use of the Foreign Corrupt Practices Act (FCPA) accounting provisions to regulate business decisions the agency perceives as unethical.  "I think this is the year that we really need to push back on the SEC's expansive, expanding and unsupported view of what constitutes a violation of the accounting provisions of the FCPA," Rochon said. "With new personnel at the enforcement level at the SEC, now is the time for a more sober reading of what the statute actually proscribes in this regard."
