Firm Chair Kathryn Cameron Atkinson was quoted regarding Walmart's non-prosecution agreement (NPA) with the U.S. Department of Justice (DOJ) and Securities and Exchange Commission (SEC), which resolved Foreign Corrupt Practices Act (FCPA) accounting charges regarding the alleged bribery of officials in Mexico, China, India, and Brazil. Among other issues highlighted in the NPA, the use of outside lawyers as a conduit for paying bribes was significant, Atkinson said. "Some companies still think of lawyers as lower-risk parties, but they should be treated like high-risk parties in many jurisdictions. Many cases have involved lawyers as the third party involved in the conduct."
