Aggressive enforcement of the Foreign Corrupt Practices Act continues to be a priority for the U.S. Department of Justice and Securities and Exchange Commission. Prosecutors have made it clear that anti-corruption enforcement will continue, particularly in the oil and gas and related services industries. However, as we have seen from investigations over the last year, no industry is immune from FCPA enforcement. Recent cases involving such companies as Wal-Mart, Oracle, Tyco and Morgan Stanley highlight the importance of having a compliance program and internal controls that are robust and sophisticated enough to withstand the impact of a government investigation.
