Trends to Watch in DOJ Cartel Investigations This Year

Law360

In this article, Lauren Briggerman discusses anticipated trends in Department of Justice (DOJ) cartel investigations in 2017. As the global auto parts investigation nears its completion with no major investigation to replace it, DOJ likely will focus on smaller, domestic investigations over the next year that decline to generate the blockbuster fines DOJ has seen in the past, Briggerman wrote. She also foresees fewer charges against foreign executives, although those charged likely will continue to refuse  to plead guilty. Finally, Briggerman questions whether 2017 will signal a trend away from investigations that are derived from the Antitrust Division's longstanding leniency program.
