Timothy O'Toole discussed how lawyers are fielding more client requests wanting to prove they should be removed from sanctions risk databases, which include public and corporate intelligence databases as well as internal watchlists of financial institutions. Banks heavily rely on intelligence databases or adverse media reporting, and being on these lists can hinder a client's ability to get a bank account or they could lose out on business. "In part, it's a function of more active compliance groups… You've got compliance groups in financial institutions that are much more active now because there have been big fines" from the Office of Foreign Assets Control (OFAC) and others, O'Toole said, adding that "There's a lot more screening going on." The problem is that many of these lists are inaccurate or misleading, which creates issues for clients that can be difficult to fully unwind.
