Reading the Tea Leaves: Predicted Trends for DOJ Cartel Investigations in 2017

In this article, Lauren Briggerman discusses recent trends in Department of Justice (DOJ) Antitrust Division cartel investigations and predicts what may be on the horizon in 2017. "For the first time in almost a decade, the Antitrust Division does not appear to have a significant, multi-jurisdictional investigation to occupy its time and resources," Briggerman wrote. This lack of global cartel investigation activity, a shift toward smaller domestic investigations, and the refusal of executives to plead guilty, among other trends, make it likely that corporate fines will remain modest in 2017. Overall, she wrote, "the trends that emerged in 2016 likely will magnify in 2017."
