Miller & Chevalier Attorney Homer Moyer Named To Ethisphere Institute List Of FCPA “Attorneys Who Matter”

Washington DC, July 30, 2009  –  Miller & Chevalier Chartered today announced that Homer Moyer has been named to the 2009 Ethisphere Institute FCPA “Attorneys Who Matter” list, which recognizes leading legal professionals who have excelled in and made a significant contribution to the corporate compliance space.

The research-based Ethisphere Institute is a leading international think tank dedicated to the creation, advancement, and sharing of best practices in business ethics, corporate social responsibility, anti-corruption, and sustainability. The following criteria were used by Ethisphere in determining the list of winning attorneys: recognized expertise, peer/client endorsements, high-profile litigation, number of cases won, high-profile clients, public service, legal community engagement, academic involvement, and other awards and recognitions.

Mr. Moyer founded Miller & Chevalier’s International department, chaired the department for 19 years, and served on the firm’s Executive Committee for a decade. He has a diverse international and litigation practice. A political appointee in both Democratic and Republican administrations, Mr. Moyer served as General Counsel (1980-81) and Counselor to the Secretary (1979) of the U.S. Department of Commerce. He is a past chair of the American Bar Association's Section of International Law, co-founder of the ABA's Central European and Eurasian Law Initiative (CEELI), and founder and chairman of the CEELI Institute in Prague.

Corporate compliance, long a component of Miller & Chevalier’s international regulatory practices, has become a separate discipline and practice group of its own. Mr. Moyer has assisted dozens of corporate clients in developing compliance programs and innovative enhancements to them. He produced Comply But Compete, one of the earliest FCPA compliance training videos, and during his chairmanship of the Institute for International and Comparative Law in Dallas, the Institute launched its unique annual conference on International Corporate Compliance. Mr. Moyer has served as an SEC-approved Independent Compliance Monitor and advised several clients with compliance monitors. Most recently, Mr. Moyer authored an article entitled “Complying with the FCPA in a Down Economy.” Since 2007, Mr. Moyer has been Chair of the IBA's Anti-Corruption Committee.

Mr. Moyer has counseled numerous clients on export issues of first impression, and been called to testify as an expert witness. He has also represented governments or private clients in connection with World Trade Organization (WTO) disputes, free trade negotiations, and disputes before bi-national panels and "Extraordinary Challenge" tribunals under the North American Free Trade Agreement and Canadian Free Trade Agreement. He has been counsel in landmark anti-dumping and countervailing duty cases, in trade and investment disputes, and in federal court cases involving issues of international law. Mr. Moyer has represented clients before all levels of federal courts, including the U.S. Supreme Court. He co-authored the book Export Controls as Instruments of Foreign Policy and while in government, co-authored the Anti-Boycott regulations of the Export Administration Act.

In 2008, the American Bar Association’s International Law Section honored Mr. Moyer with a Lifetime Achievement Award. He has been ranked and recognized in various publications, including Chambers, Guide to the World's Best International Trade Lawyers and Who's Who Legal: Trade & Customs, for his accomplishments in the area of international trade. Mr. Moyer is a member of the Council on Foreign Relations and has served on the Boards of Trustees of the Center for American and International Law and the Council for Excellence in Government.
