Matteson Ellis was quoted regarding the Brazilian enforcement climate following the Petrobras scandal as the country endeavors to eradicate corruption. The country adopted its Clean Companies Act, which many lawyers feel has flaws due to its framework. The Act requires a company to admit guilt without giving executives criminal immunity, allows leniency to be given only from the comptroller general and does not include a framework to coordinate with numerous state and local authorities. A recently proposed amendment would address some of the issues, however a vote has been postponed until May. "These guys are building the plane while they're flying it," Ellis said regarding the key details that must be worked out to build effectiveness.
