Homer Moyer discusses the announcement by Assistant Attorney General Lanny Breuer, head of the Justice Department's Criminal Division, that the agency will issue FCPA guidance for the first time in 2012. "This is a big step," said Homer Moyer. He added that the tease of the guidance amounted to only about two sentences of Breuer's remarks, and that there were few details about what would be in it, let alone whether it would address changes to the law sought by business groups, including the U.S. Chamber of Commerce. Nevertheless, Moyer said Breuer's remark about the guidance is "pretty significant" because the Justice Department hasn't issued guidance under the FCPA amendments for 23 years.
