Timothy O'Toole commented on the inclusion of Semiconductor Manufacturing International Corp (SMIC) of China on the Entity List, which restricts the export of certain U.S. technology to the listed entities without a government license. O'Toole pointed out that SMIC could pursue litigation (which is very challenging) or could pursue the option of going to the End-User Review Committee (ERC) – which makes decisions regarding additions to, removals from, or other modifications to the Entity List – to ask them to remove it from the list but that that will still be a long and difficult process.
