Margot Laporte was quoted on a judge's acquittal of former Alstom executive Lawrence Hoskins on foreign bribery charges, raising new questions about the U.S. Department of Justice's (DOJ's) ability to pursue non-U.S. citizens for violations of the U.S. Foreign Corrupt Practices Act (FCPA). The decision is particularly important because the standard for overturning jury decisions is "such a high bar," Laporte said. The decision could cause the DOJ "to pull back" on its application of "agency" when considering potential FCPA cases, she added, noting that, after Hoskins was convicted, criminal chief head Brian Benczkowski said the DOJ was not looking to push the boundaries of "agency."
