In this article, James Tillen and Saskia Zandieh* discuss the Resource Guide on the U.S. Foreign Corrupt Practices Act, released in November, 2012, by the Department of Justice and the U.S. Securities and Exchange Commission. The Guide, while not legally binding, provides a thorough overview of the FCPA, useful insights into the enforcement agencies' interpretations of the law, an understanding of the agencies' enforcement practices and guidance on areas at the core of interest groups' calls for reform.
