Tess Gee Quoted on Church Plan ERISA Cases Before the Supreme Court in HR Magazine

Tess Gee was quoted in regard to the church plan cases before the Supreme Court. Currently church plans are exempt from Employee Retirement Income Security Act (ERISA) reporting obligations and other regulations. However a 1980 amendment to the law said that exempt plans may be maintained by organizations that are controlled by a church but does not say whether church plans can be established by affiliated organizations such as hospitals. "I think everyone would agree that the 1980 amendment was not the model of statutory drafting," Gee said. The justices are now poised to interpret that language and are expected to rule in June.
