“Companies don't have to turn over tax papers: U.S. appeals court”

Financial Week

Kevin Kenworthy comments on the U.S. Court of Appeals for the First Circuit decision upholding a lower court decision that Textron Corp. did not have to provide the IRS with tax accrual work papers it shared with its independent auditor. Kenworthy, who along with Alan Horowitz represented Financial Executives International in an amicus brief for Textron, said that while the appeals court largely affirmed the decision in favor of the company, the IRS may fight all the way to the high court. “Corporate taxpayers need to continue watching the case,” he says, noting that “the IRS expected to be vindicated on appeal.”
