Andy Wise comments on U.S. v. Bruno as one of the cases that white collar lawyers will be closely watching in 2013. Former New York State Senate Majority Leader Joseph Bruno is currently being retried by the government after the Supreme Court decision in the case of Jeffrey Skilling, which limited the Honest Services fraud statue to bribery and kickbacks cases. The outcome of this case could change how honest services investigations are handled in the future.

"From a jury standpoint, the challenge for Bruno is making sure the trial court forces the jury to focus on and find the elements of bribery and doesn't get side-tracked by its distaste for conduct that satisfies the old notion of honest services fraud," Wise said.
