Andrew Wise was quoted regarding ex-Virginia Governor Bob McDonnell's sentencing following corruption charges related to honest-services fraud. While prosecutors sought a prison term of 10 to 12 years, McDonnell was sentenced to two years for his crimes. The sentence was a win for McDonnell's team, Wise said, adding that in sentencing him to substantially less time than what prosecutors had sought, the district judge exercised discretion that's becoming increasingly common as judges struggle to distinguish between actual lawbreaking and merely tawdry conduct. "I think judges are seeing unethical, arguably immoral, conduct that's not as clear cut as criminal behavior" that prosecutors portray to jurors, he said. Still, "two years in a federal penitentiary is not a slap on the wrist."
