Timothy O'Toole, Member and White Collar Defense Practice Lead at Miller & Chevalier Chartered, commented on a rare U.S. court victory by Xiaomi, a Beijing-based electronics manufacturer, and how this ruling should encourage other Chinese companies accused of secret links to the country's military to contest Trump-era sanctions. Xiaomi was one of 24 Chinese business that the Trump administration slapped with a U.S. investment ban in November 2020 based on a Department of Defense (DoD)-prepared list of companies that pose a threat to U.S. national security because of their alleged military links. "I do expect that many other listed companies will explore their options and potentially pursue similar litigation after reviewing what happened in this case," O'Toole said.
