Matteson Ellis, Member at Miller & Chevalier Chartered and author of The FCPA in Latin America, told Latinvex that he expects a new boldness in enforcement from the Biden Administration. "This could include further pursuit of Latin America investigations already underway, for example Pemex-related investigations, and a willingness to build new cases, including those involving COVID-related wrongdoing," Ellis said. As several Latin American governments are backsliding or slowing down in their battles against corruption, the US has continued to investigate and sanction violations of the Foreign Corrupt Practices Act (FCPA) in the region. "In 2020, the number of overall FCPA enforcement actions went down, likely due in part to COVID-related effects on investigations. But the share of FCPA enforcement activity related to Latin America increased," Ellis added.
