Brian Fleming Quoted Regarding Lawmakers Concerns Over CFIUS Regulations in Law360
"5 Questions Attys Want Answered By CFIUS Rulemaking"
Brian Fleming was quoted regarding the need for highly anticipated guidance from the Committee on Foreign Investment in the United States (CFIUS) related to the implementation of the Foreign Investment Risk Review Modernization Act (FIRRMA), signed into law in August 2018. Access by foreign investors to sensitive personal data of United States citizens was one of the primary concerns underlying FIRRMA and the forthcoming CFIUS guidance will have a major impact on a wide range of companies. "In some ways this is a concern that has been growing at CFIUS over the last couple of years. So it's not a new one but ... has the potential to really be so broad in terms of the types of companies it implicates that it will be interesting to see how that is being defined and what the additional guidance and examples are," Fleming said.
