Brian Fleming, former Counsel to the Assistant Attorney General for National Security at DOJ, commented on Microsoft's potential acquisition of TikTok in the U.S., Canada, Australia, and New Zealand from its parent company, ByteDance. Microsoft’s relationship with China and its government officials, which Microsoft has spent decades building, could spur increased scrutiny of the deal, Fleming said. A different U.S. buyer might not face as much scrutiny, as ties with the Chinese government are viewed skeptically, he said, adding that a sale to a company like Microsoft makes it easier for the U.S. to make sure the data is properly stored.
