Brian Fleming commented on the case against former Hong Kong government official, Patrick Ho, under the Foreign Corrupt Practices Act and why Ho is not facing criminal charges for acting as an unregistered agent of a foreign government. Fleming, a former Counsel to the Assistant Attorney General for National Security at the Department of Justice, explained that bringing such charges can be difficult without declassifying sensitive information. "If there is a way to try a case without having to declassify classified information, the government is likely going to do that," Fleming said.
