Anthony F. Shelley, speaking at the National Association of Insurance Commissioners summer meeting, commented on the ongoing litigation surrounding the Affordable Care Act (ACA). Texas v. United States – in which the state argues that the ACA's individual mandate and related provisions are unconstitutional – poses a "serious and potentially mortal challenge to the ACA in the individual market," Shelley said, adding that states look as if they're fighting a "litigation 'civil war'" with each other over a number of ACA-related issues.
