In this article, Lauren Briggerman, Dawn Murphy-Johnson, and Kirby Behre discuss recent developments in government investigations targeting corporate executives, including the Volkswagen emissions scandal, Caterpillar tax investigation, and Operation Carwash. A common theme across these investigations has been the increasingly aggressive tactics used by prosecutors, including multi-agency raids of corporate offices, raids of outside counsel, and high-profile arrests. "Despite these aggressive tactics by prosecutors, we note that there have been relatively few charges brought against corporate executives in major government investigations this spring," the authors wrote. "For example, no executives were prosecuted on [FCPA]-related charges. In cartel cases, only one executive has been charged on antitrust charges in a global investigation and only a handful have been prosecuted in smaller domestic investigations."
