A Check-up For Your Worksite Wellness Plan: Avoiding Tax and Legal Pitfalls

January is the time to focus on your health and it is also a good time for employers to review the health of their wellness plans. Employers have increasingly focused on implementing wellness plans as a means to improve the overall health of their workforces, reduce health care costs, and increase productivity. There are a number of tax and legal considerations that must be taken into account in designing and operating wellness plans, including potential tax consequences to employees and employers in connection with wellness "rewards," nondiscrimination requirements, employee privacy concerns under HIPAA, and compliance with the Americans with Disabilities Act.
