| Richard Hibey focuses his practice on white collar criminal and antitrust matters, corporate and federal securities law, and complex commercial transactions. Mr. Hibey has represented high-profile clients in cases that have involved espionage, human rights violations, Racketeering Influenced and Corrupt Organizations (RICO), and other white collar crimes and complex civil matters. He was trial counsel for Sun-Diamond Growers of California when it was prosecuted by the Office of Independent Counsel investigating former Secretary of Agriculture, Michael Espy. The Supreme Court ultimately sustained the Circuit Court’s reversal of the conviction. Mr. Hibey was also chief counsel for the Special Bid Oversight Commission of the U.S. Olympic Committee, which investigated the events leading to the selection of Salt Lake City to host the Winter Olympics. Mr. Hibey’s distinguished career includes representing high profile clients and cases, including heads of state such as Ferdinand Marcos, former president of the Philippines; Israeli spy Jonathan Pollard; and Iran-Contra figure Clair George, former espionage chief for the Central Intelligence Agency (CIA). He represented Mary Mapes, producer of the Dan Rather 60 Minutes story on President Bush’s National Guard Service, in a 2005 CBS internal investigation, and he served as American defense counsel in a criminal prosecution by the Ukrainian government against a leading Ukrainian elected official in connection with pre-trial detention, constitutional, and international human rights issues, including possible proceedings in the European Court of Human Rights.
Mr. Hibey has published articles and spoken on a variety of subjects, including the Foreign Corrupt Practices Act (FCPA), jury selection, grand jury defense practice, health care fraud, and civil liberties in the aftermath of 9/11. He taught criminal law for 13 years at American University’s Washington College of Law, where he was an Adjunct Professor.
