Resolved FCPA Enforcement Actions Drop To 10-Year Low

In this article, Marc Alain Bohn and Michael Skopets analyze U.S. Foreign Corrupt Practices Act (FCPA) enforcement trends from 2015. "During the last quarter of 2015 in particular, the pace of enforcement nearly slowed to a halt after a fairly robust third quarter, with the U.S. Securities and Exchange Commission entering into only one resolved enforcement action and the U.S. Department of Justice entering into none," Bohn and Skopets said. "This lack of activity by the agencies was somewhat surprising because the pace of FCPA enforcement has historically tended to pick up toward the end of the year." This article is excerpted from Miller & Chevalier's FCPA Winter Review 2016, which is available here.
