Andrew C. Strelka

Andrew Strelka is Counsel in the Tax Department, focusing on tax litigation, enforcement and investigations. Prior to joining Miller & Chevalier, Mr. Strelka served as a trial attorney at the U.S. Department of Justice (DOJ), Tax Division. At DOJ, Mr. Strelka represented the United States as lead counsel in a wide variety of civil litigation in federal district and bankruptcy courts throughout the country. Mr. Strelka has extensive experience in tax refund suits, matters concerning the Administrative Procedure Act, tax-exempt organizations and bankruptcy proceedings, having represented the United States in more than one hundred bankruptcy matters.   • Lead government attorney on a five-day jury trial resulting in $2.8M win.
  • Successfully defended a $1.4M claim for federal taxes in a hospital's Chapter 11 reorganization, including appeal from the bankruptcy court to the district court.
  • Second chair on a $11M transfer pricing bankruptcy trial against the domestic subsidiary of a Chinese manufacturer/distributor.
  • In a matter of first impression, successfully argued before the Sixth Circuit Bankruptcy Appellate Panel that a Chapter 11 debtor's payment of $600K of pre-petition penalties resulted in reasonably equivalent value.
